Backyard Garden Mini Photo Sessions — Terms, Waiver & License

By booking a session and checking “I agree,” you accept these Terms, including the release of liability, required model release, and license terms.
What You’re Buying
15‑minute mini session in a private, award‑winning residential garden.
15+ hi‑res edited color photos delivered within 24 hours via online gallery.
Personal print/share rights (see License).
Price Offerings:
$200 per 15‑minute session, paid at booking.
$400 per 30‑minute session, paid at booking.
Safety, Assumption of Risk & Release
The garden has natural terrain and photo equipment (uneven ground, steps, cables, stands, sandbags, insects, weather). You agree to stay in designated areas, supervise minors, and avoid touching gear. You voluntarily assume all ordinary risks. To the fullest extent permitted by law, you release and hold harmless Photographer/Studio, owners, agents, property owners, and contractors from claims for injury, illness, or property damage arising from ordinary negligence or inherent risks. This does not waive claims from gross negligence/willful misconduct where prohibited by law.
Health & Preparedness
Disclose relevant allergies, sensitivities, mobility needs, or medical conditions before the session. Bring your own medications (e.g., EpiPen). In an emergency, Photographer may call 911 at Client’s expense.
Minors
A responsible adult must actively supervise minors at all times. No running, climbing, or rough play near equipment.
Pets
Pets require prior approval, must be leashed/controlled, and cleaned up after. Owner is responsible for any injury or damage caused by their animal.
Property Rules & Privacy
Respect the home/neighborhood. Stay in permitted areas. No smoking, vaping, flames, glitter/confetti, or alcohol without written consent. Do not photograph or record neighbors or neighboring properties.
Payment, Scheduling & Tardiness
Payment of $200 or $400 depending on session length is due at booking; appointments are confirmed upon successful payment. A 3‑minute grace period applies; late arrival reduces shooting time. 7+ minutes late is a no‑show and non‑refundable.
Weather, Rescheduling & Cancellations
Client reschedule: Free up to 48 hours before session. Inside 48 hours is non‑refundable.
Photographer weather call (e.g., lightning, high winds, heavy rain/extreme temps): You choose a free reschedule or refund of undelivered services.
Force Majeure (events beyond reasonable control—illness, power outage, accident, government orders, acts of God): Photographer may reschedule or refund session fee—exclusive remedy.
Money‑Back Guarantee
If you’re not satisfied with the final edited images for any reason, email within 7 days of delivery to choose a free re‑shoot or a full refund of your session fee. No hassle. You keep delivered images for personal use.
Intellectual Property & License (Personal Use Only)
Photographer owns all copyrights to images (“Images”). Upon delivery and full payment, you receive a non‑exclusive, non‑transferable, perpetual personal‑use license: print for personal display/gifts and post on personal (non‑commercial) social media with credit/tag to Photographer.
Prohibited without written permission and a paid Commercial License: any business/promotional/revenue‑generating use (websites, ads, listings, sponsorships, influencer/affiliate posts, publications, contests, merchandise, training AI models, resale). Do not remove metadata/watermarks or apply heavy edits/AI synthesis beyond basic cropping/exposure. Third‑party vendors may use Images only to fulfill your personal order. Commercial License available upon request.
Model Release (Required)
You grant Photographer permission to use Images featuring you and your party (including minors) for portfolio, website, social media, studio samples, and advertising without additional compensation. If you cannot agree to this model release, please do not book this offer.
Editing, Delivery & Archiving
Photographer delivers at least 15 edited hi‑res Images within approximately 24 hours via online gallery. RAW files are not provided. Reasonable re‑edit requests may be purchased separately. Galleries remain online at least 60 days; archival retrieval after that is not guaranteed and may incur a fee. Please download and back up promptly.
Damage & Indemnification
You are responsible for damage to property/equipment caused by you, your party, minors, or pets. You agree to indemnify and defend Photographer against third‑party claims arising from your conduct or breach of these Terms.
Limitation of Liability
Photographer’s total liability for any claim relating to the session or Images shall not exceed fees paid by you. No liability for incidental, consequential, special, or punitive damages where permitted by law.
Accessibility Notice
The garden includes steps and uneven surfaces and is not wheelchair accessible. If accessibility is a concern, contact us before booking to discuss alternatives.
Governing Law, Venue & Dispute Resolution
Louisiana law governs. Venue is state courts in East Baton Rouge Parish unless both parties agree to small‑claims court. Jury trial waived to the extent permitted by law. The prevailing party may recover reasonable attorneys’ fees and costs.
Miscellaneous
These Terms are the entire agreement and supersede prior discussions. Amendments must be in writing. If any provision is unenforceable, the remainder stays in effect. Electronic acceptance/signatures are valid.
